1. Acceptance of Terms

By accessing and using Safer Pilot ("Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. Description of Service

Safer Pilot provides a platform for flight schools and flight instructors to manage their business operations, including but not limited to:

• Student and instructor management
• Flight training session scheduling
• Aircraft management
• Flight log tracking and endorsements
• Invoicing and payment processing
• Business analytics and reporting

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities under your account

4. Subscription and Billing

Safer Pilot operates on a subscription-based model with the following terms:

• Subscriptions are billed on a monthly basis
• Payment is due at the start of each billing cycle
• You may cancel your subscription at any time
• Cancellations take effect at the end of the current billing period
• No refunds will be provided for partial months of service
• We reserve the right to change subscription pricing with 30 days notice

5. Payment Processing

For organizations using our invoicing features, Safer Pilot facilitates payment processing through Stripe Connect. By using these features, you agree to:

• Comply with Stripe's Terms of Service and applicable laws
• Provide accurate business and banking information
• Pay platform fees as outlined in your subscription tier
• Handle customer disputes and chargebacks appropriately

6. Acceptable Use

You agree not to use the Service to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Transmit malicious code or viruses
• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service or servers
• Use the Service for any fraudulent or illegal purposes
• Impersonate any person or entity
• Share false or misleading information

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to our collection, use, and disclosure of your data as described in the Privacy Policy.

You retain ownership of all data you submit to the Service. You grant us a limited license to use your data solely for the purpose of providing the Service to you.

8. Aviation Compliance

While Safer Pilot provides tools to assist with flight training management, you are solely responsible for:

• Ensuring compliance with all FAA regulations and requirements
• Maintaining accurate flight logs and records
• Verifying the accuracy of endorsements and certifications
• Meeting all training and currency requirements
• Maintaining appropriate insurance coverage

Safer Pilot is a software tool only and does not provide aviation advice, training, or certification services.

9. Intellectual Property

The Service and its original content, features, and functionality are owned by Safer Pilot and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

10. Limitation of Liability

To the maximum extent permitted by law, Safer Pilot shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, or other harmful code transmitted through the Service
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service

11. Indemnification

You agree to defend, indemnify, and hold harmless Safer Pilot and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Service, or your violation of these Terms.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. Your continued use of the Service after the effective date of the revised Terms constitutes acceptance of those terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
